Changes to This Privacy Policy

GENERAL RULES ("RULES") FOR THE FREE PRIZE DRAW

  1. Participants You must be a UK, Isle of Man or Channel Islands resident and be over 18 years of age. Our decision as to the eligibility of a person in accordance with these criteria shall be final. ("Valid Entry").

    Only one entry per household.
  2. How to enter You are eligible to enter provided you fill in your mobile number. Please be aware we will use this to contact you.
  3. Conduct of the Draw This is a free prize draw. The draw will take place on 31st March 2008 or on an alternative date, (which we may decide at our discretion but which we will announce on this Website prior to such draw taking place). There shall only be one prize and one winner and we will publish the details of the winner on the Website following the prize draw. All valid entries will be collated and will compete for the prize. The winner will be the first valid entry drawn at random on the date the draw is conducted. The prize claim must be made in accordance with Rule 4 below. The Judge's decision is final.
  4. The Prize We will provide the winner with a Nokia N82 but the prize does not include a SIM card or any network connection. The winner's notification will be despatched by text within 30 days of the draw. The prize is awarded conditionally upon the acceptance by the winner. If the prize is unclaimed within 30 days it shall lapse and we shall carry out the draw a further time on the same basis as set out in these Rules.
  5. Responsibility This is a free draw and we do not accept any liability for any losses caused in relation to this Prize Draw.
  6. Our rights We may substitute a prize deemed to be an appropriate replacement and of equal or greater value in place of the prize.
  7. Law The Rules are governed and interpreted under English law. The parties submit to the exclusive jurisdiction of the English courts.

The purpose of the Website is to allow visitors to track the progress of James Cracknell's Cross-Continent Challenge in aid of Sport Relief and for visitors to receive details and updates of James' progress ("James Cracknell's Updates").

By using the Website and by requesting James Cracknell's updates you acknowledge that you have read and you agree to be bound by and comply with these Terms and Conditions, in particular our use (on Nokia's behalf) of your personal data as set out in the Privacy Policy at clause 2.

You have the right to see the personal data (as defined in the Data Protection Act 1988) that we keep about you, on receipt of a written request, verification of your identity, and payment of a fee to be no more than £10. Use of the Information is provided by us, free of charge. However, your mobile operator may charge for the data. We do not accept any liability for any costs or charges associated with downloading of the Information chargeable by your mobile operator. All messages that you send to us are free of any charges payable to us. However, your mobile operator will charge you their mobile operator tariff for sending a message to us.

Severance

Force Majeure

We shall not be liable to you for any delay in, or failure of, performance of our obligations under these Terms and Conditions arising from any cause beyond our reasonable control including any of the following: act of God, governmental act, war, fire, flood, explosion or civil commotion, failure in information technology or telecommunications services, failure of a third party (including failure to supply data) and industrial action.

Law and Jurisdiction

These Terms and Conditions will be governed by and construed in accordance with the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Certain provisions contained in these Terms and Conditions may be disallowed by the laws of the country from which you are accessing the Information. If any provision is unenforceable or invalid then the provisions of paragraph 8 shall apply.
